Found inside a Wash Post chat:
Conway, Ark.: So let me get this straight--of course the warrantless snooping is legal, says the Bush administration, because the program was vetted by executive branch lawyers, who exercised legal judgment independent of their client, we're supposed to believe. Meanwhile, down the street, we shouldn't put too much stock in things Sam Alito wrote in the 80s when he was a government lawyer in the Reagan administration, because he was just doing his client's bidding.
Which is it?
This question was originally asked in a chat with Post National Political Editor John Harris, as the page you linked to (chat with Dan Balz) explains.
Dan Balz didn't respond in his chat, and neither did Harris, other than to say he would refer it to White House Reporter Michael Fletcher. Harris also said to the original questioner:
"I like your question, even if it is perhaps a bit argumentative."
No wonder Dan Froomkin is feeling the heat for not being a pussy cat.

“Which is it?”
And why should I care? I am fed up with the hypocrisy. Ruth Bader Ginsberg simply refused to answer such dumb questions. If that was good enough for her---why isn’t it sufficient for Samuel Alito?
The days of the leftist media dominating the nation’s agenda is over. Fewer people give a damn what the New York Times, Washington Post, or Slate.com have to say about these matters.

Lovely and constructive comment David, though I'm not sure anyone actually asked you to care.
